Terms of Service

1. Who we are and acceptance of these terms

In these Terms, "SugaTone", "we", "us" and "our" refer to the SugaTone application, website and related services operated by Salami Abiodun Akorede, based in Manitoba, Canada.

By accessing this website or using the SugaTone application, you agree to these Terms of Service. If you do not agree, please do not use the service.

2. Eligibility

You must be at least 18 years old to use SugaTone, and you must be legally able to enter into these Terms in your jurisdiction. SugaTone is not intended for, or directed to, anyone under 18. The application may ask for your age as optional profile information, but it does not technically verify or enforce your age; you are responsible for confirming that you meet this requirement.

3. Your account and account security

Using SugaTone requires an account created with an email address and authentication credentials. You are responsible for providing accurate account information, keeping your authentication credentials confidential and taking reasonable steps to protect access to your account. You are responsible for activity conducted through your account to the extent reasonably within your control. You should notify SugaTone promptly if you believe your account has been accessed or used without authorization.

4. Free service at launch

SugaTone is currently provided free of charge. There are no subscriptions, in-app purchases, paid plans, advertising or affiliate monetisation in the current version. We may introduce paid features in the future; if we do, they will be offered under updated terms that are presented to you before any charge applies.

5. Permitted use and licence to you

SugaTone is provided for your personal, non-commercial use. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use SugaTone. You agree to use it only in ways permitted by these Terms and applicable law.

This licence does not transfer to you any ownership of the SugaTone software, interface, content or other intellectual property, and all rights not expressly granted are reserved.

6. Wellness positioning and no medical advice

SugaTone is a general wellness, informational and self-tracking product intended to help you record and understand your own information over time.

SugaTone is not a medical device. It does not provide medical diagnosis, medical treatment or medical advice, it is not an emergency monitoring service, and it does not replace a physician or other qualified healthcare professional. SugaTone does not continuously monitor you and should not be relied upon to detect a medical emergency. It is not intended to diagnose, treat, cure or prevent any disease.

Glucose readings, ketone readings, Glucose–Ketone Index (GKI), fasting timers, trends, correlations, statistical observations, AI-generated insights and other information displayed by SugaTone are provided for informational and self-tracking purposes. They should not be interpreted as a diagnosis or as instructions to begin, stop or change medication, fasting, diet, treatment or other medical care.

If you use medication or have a medical condition that may be affected by fasting, diet, glucose or ketone levels, seek appropriate professional medical advice before making significant changes based on information displayed by SugaTone.

If you experience an abnormal, concerning or unexpected measurement, or any symptom that concerns you, seek appropriate professional medical assistance rather than relying on SugaTone. Always seek the advice of a qualified health professional with any questions about a medical condition, and never disregard professional advice because of something shown in the app.

7. AI-generated insights

SugaTone may use artificial-intelligence systems to generate personalised informational insights from selected profile information and pre-computed statistical observations derived from information you record.

• AI-generated output may be incomplete
• AI-generated output may be inaccurate or contain errors
• AI-generated output may not apply to your individual circumstances
• AI-generated output is informational and wellness-oriented, and is not medical advice
• AI-generated output must not be relied upon for diagnosis
• AI-generated output must not be relied upon for treatment decisions
• AI-generated output must not be relied upon for emergency decisions
• You remain responsible for obtaining appropriate professional healthcare advice

AI-generated insights may identify associations, patterns or statistical relationships in information you record. Such associations do not establish cause and effect.

An AI-generated statement should not be interpreted as proof that a meal, fasting duration, exercise session, sleep pattern, medication or any other factor caused a particular glucose, ketone or other health outcome. AI-generated output is not clinically validated.

8. Your responsibility and data quality

You are responsible for the information you enter and for any decisions you make.

The accuracy and usefulness of SugaTone's calculations, trends, correlations, statistical observations and AI-generated insights depend in part on the accuracy, completeness, timing and consistency of the information you enter. SugaTone does not verify the accuracy of measurements you enter.

To the maximum extent permitted by applicable law, SugaTone is not responsible for inaccurate or misleading outputs arising from:

• Incorrect user-entered data
• Incomplete data
• Mistimed entries
• Incorrect units
• Inaccurate external glucose or ketone measuring devices
• Faulty or improperly used measuring equipment
• Information obtained from third-party devices or services
• Your interpretation of SugaTone outputs

SugaTone does not monitor your health and must not be relied on in an emergency. In an emergency, contact your local emergency services.

9. Intellectual property and your information

Subject to applicable law, the SugaTone name, logo, branding, software, source code, interface, visual designs, graphics, text, educational content including the materials on the Science page, original illustrations, calculation implementations, proprietary presentation of analytics, documentation and other original SugaTone materials are owned by or licensed to Salami Abiodun Akorede and are protected by applicable intellectual property laws. We do not claim ownership of third-party materials or of scientific concepts, facts or published research referred to in our content.

You retain ownership of the information you enter.

You give us a limited, non-exclusive licence to host, store, process, reproduce and display information you submit only as reasonably necessary to operate and provide SugaTone's features to you, subject to our Privacy Policy. This licence does not transfer ownership of your information to us.

10. Prohibited conduct

• Using the service unlawfully or for an unlawful purpose
• Attempting to gain unauthorised access to the service, its systems or another user's information
• Interfering with or circumventing security controls or access restrictions
• Introducing malicious code or otherwise compromising the integrity of the service
• Automated abuse of the service, or scraping where not authorised
• Interfering with, disrupting or overloading the service or its infrastructure
• Impersonation, fraud or other deceptive conduct
• Reverse engineering, copying or reselling the service, except where such activity cannot lawfully be restricted under applicable law
• Infringing SugaTone's or a third party's intellectual property rights
• Using SugaTone to violate another person's privacy or to misuse another person's information
• Misrepresenting the service, including as a medical device, diagnostic service or healthcare provider

Good-faith security research conducted lawfully and responsibly, without accessing other users' information or degrading the service, is not intended to be prohibited by this section. Please report any suspected vulnerability to us using the contact details below.

11. Availability, changes and keeping your own copies

We aim to keep SugaTone available and reliable, but the service may be interrupted, modified, unavailable, changed or discontinued, and features may change over time. To the maximum extent permitted by applicable law, we do not guarantee uninterrupted, timely, secure or error-free availability of the service.

You are responsible for retaining copies of information you consider important. SugaTone should not be used as the sole repository for information you need to preserve.

This section does not reduce our responsibilities under our Privacy Policy or under applicable law.

12. Third-party services

SugaTone relies on third-party service providers to operate, including Base44, which provides backend infrastructure, storage, authentication, backend functions and the AI integration layer. Where you obtain the application through an app store or distribution platform, that platform's own terms also apply to you.

Third-party services may be subject to their own terms, availability and privacy practices. To the extent permitted by applicable law, SugaTone is not responsible for acts, omissions, outages, changes or failures of independent third-party services that are outside SugaTone's reasonable control. This does not affect our own obligations to you under applicable law.

13. Data and deletion

Our handling of your information is described in the Privacy Policy. You can delete your health data through the application, which keeps your account and profile in place, and you can separately delete your account and associated personal information through Settings in the application. SugaTone Support can assist if a deletion cannot be completed normally.

14. Disclaimers

To the maximum extent permitted by law, the service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that calculations, trends, correlations, statistical observations, AI-generated insights or other outputs will be error-free, complete, accurate or suitable for any particular health or medical purpose.

To the maximum extent permitted by law, we also do not warrant that:

• The service will always be available
• Data transmission will always be uninterrupted
• Every software error will be identified or corrected
• Information displayed will be appropriate for your particular medical circumstances

Nothing in this section excludes warranties or statutory protections that cannot lawfully be excluded.

15. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential or exemplary damages, or for any loss of data, profits or goodwill arising from your use of the service.

To the maximum extent permitted by law, and except where liability cannot lawfully be limited, we will also not be liable for loss or damage arising from reliance on, or from:

• Information you have entered, including inaccurate, incomplete or mistimed entries
• Calculations, trends, correlations and statistical observations shown in the app
• Fasting timers and Glucose–Ketone Index (GKI) values
• AI-generated insights
• Interruptions, downtime or discontinuation of the service
• Acts, omissions or failures of independent third-party services
• Unauthorized activity on your account that is outside SugaTone's reasonable control

Nothing in these Terms excludes or limits any liability, right or remedy that cannot lawfully be excluded or limited under applicable law, including liability for fraud, wilful misconduct or gross negligence, and including applicable mandatory consumer-protection rights.

16. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless SugaTone and Salami Abiodun Akorede from third-party claims, liabilities, damages and reasonable costs arising from:

• Your unlawful use of SugaTone
• Your material breach of these Terms
• Your infringement of another person's rights
• Your unauthorized use or misuse of another person's information
• Content or information you submit in violation of law or of third-party rights

This does not apply to claims arising from our own fraud, wilful misconduct, gross negligence or breach of law, or in any other circumstance where indemnification cannot lawfully be required.

17. Suspension and termination

You may stop using SugaTone at any time. We may suspend or terminate access where reasonably necessary, including for breach of these Terms, unlawful activity, fraud, security threats, abuse of the service, threats to other users or to our infrastructure, or where suspension is otherwise reasonably necessary to protect SugaTone or its users.

Where reasonably practicable, suspension or termination by us will not affect rights you may have under applicable law concerning access to or deletion of your personal information.

18. Changes to these terms

We may update these Terms from time to time. We will update the date at the top when changes are made. Where required by applicable law, we will provide additional notice or obtain consent before materially changed terms take effect.

19. Governing law

These Terms are governed by the laws applicable in the Province of Manitoba, Canada, without regard to conflict-of-law principles, and the courts of Manitoba will have jurisdiction over any dispute. This is subject to any mandatory consumer-protection rights available to you under the law of the place where you live.
